TERMS OF SERVICE

PAYMENT:

Full payment is required at the time of acceptance of all The Baking Connection quotations. Only once payment is made will your order be added to the baking schedule. All orders are required to have at lesat 14 days of preparation time starting post order approval. Example: If you placed your request on January 1 and your order is approved on January 3, I have 14 days from January 3 to complete your order.

 

CAKE POP CHANGES:

Changes to your cake pop order; size, description, flavour etc. will only be accepted 2 weeks prior to the Party / Event date. Charges may apply for changes. After the lock out date of two weeks, we cannot accept changes.

CANCELLATIONS

Although I do understand we can experience uncontrollable life circumstances, once your order is processed and completed, I do not offer a refund. If you cancel your order 14 days ahead of time and production has not started, I will process a full refund.

 

DELIVERY OF CAKE POPS

If you're unable to pick up your cake pop order in Gilroy, we can deliver your order anywhere in the Santa Clara County for a flat rate of $10. If you are located outside the Santa Clara County, please email us at TheBakingConnectionTeam@gmail.com so we can work together on finding a solution.

 

UNAVOIDABLE OCCURANCE:

In the case of an unavoidable occurrence, such as a car accident, poor road conditions, traffic during delivery etc. The Baking Connecting will not  be held liable for any delays or damages to the cake pops, however, we will try our very best to ensure that alternate arrangements are made to ensure that you are not completely without your order on the day of the event. We shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control and you will not be entitled to a refund.

 

COLLECTION OF CAKE POPS

Upon collection of your baked goods, any outstanding money will have to be paid. The Baking Connection will not be liable should the customer believe there are any problems with the cake once it has left the premises. This includes design, colour or the bake of the baked goods. If we have to wait for any reason after the arranged pick up time, you will be billed at $20 per hour. Also be aware your cake pop/s is possibly not the only cake we have to output on this day, so we will not be late for any other scheduled collections / deliveries that day. If we must leave without you collecting your baked goods,  your baked goods can be collected at the next earliest opportunity and might mean that your baked goods may not be set up in time for your event at no fault to us, and without refund. The correct transportation guidelines will be given to you upon collection and should these not be followed and result in damage to the baked goods in any way whatsoever, The Baking Connection will not be held liable for such damages.

 

STORAGE

All cake pop/s should be stored at cool temperatures and out of direct sunlight on a flat surface and in the fridge ONLY when advised, unless specifically advised not to. No preservatives or additives are used in The Baking Connection products therefore they should be treated as fresh food and consumed within 72 hours of the delivery/collection date.

 

WHOLESALE

Under no circumstance can any of the cake pop/s or baked goods produced at The Baking Connection be re-sold by a third party. Under no circumstances are our customers allowed to re-brand any of our baked goods to pass off as their own. Under no circumstance is any customer allowed to re-sell any of our baked goods. Failure to comply with any of the above will result in serious legal action.

 

TERMS OF BUSINESS

The Baking Connection shall not be liable for any consequential loss to the customer whether this arises from a breach of contract or any other way. The Baking Connection total liability for any claim howsoever arising shall not exceed the price of the goods supplied by The Baking Connection to the customer.

If you are unhappy with your order and/or purchase, immediately notify us (within 6 hours of pick-up) of your concern and return your goods (minimum 95% of purchased goods) to us within a maximum of 12 hours from pick-up. If possible, The Baking Connection will try its utmost to replace goods if the time frame permits. Please note pictures are for general illustration only and the final product may vary from that shown or supplied for reference purpose. Each and every bake is uniquly handmade and not mass produced. 

 

COLOURING

The colours Black, Red, Blue and Purple or any shade of these colours cannot and will not be guaranteed. These colours are very unstable and tend to fade or bleed into surrounding areas. Although we will try our best to stop this from happening we cannot guarantee this will not happen. If you require specific colours for your order you are required to supply a colour swatch to allow us to match frosting colours.
